Menachem Mendel Levy jailed for three years



Menachem Levy, 41, of Princes Park Avenue, was found guilty in May of indecent assault of a female under the age of 16 following a trial at Wood Green Crown Court.

Levy first targeted the victim, who was 14 when the abuse began, when he visited her family home in Hendon in December 1999, He then subjected her to a series of sexual assaults at other locations, including Levy’s home address, until December 2005,  

The woman suffered a “course of sexual abuse” between the ages of 14 and 21, “beginning when she was a child in the eyes of the law”, prosecutor David Markham told Wood Green Crown Court. After Mr Levy had first touched her sexually when she was 14, the abuse had escalated over years as he “forced himself on her for sexual intercourse”.

The woman — who cannot legally be identified — “did not complain during that period, because in essence she thought she was to blame,” Mr Markham said.

“This was a belief and conviction rooted in her upbringing in north London and the Orthodox Jewish community.”

Mr Levy had exploited her naivety and fears, he said, by telling the woman that she would be the one in trouble if she raised the alarm, throughout the ordeal, Levy constantly told the girl that she was to blame for the abuse and that if she told anyone she would get into trouble.

The woman, the barrister said, had resisted his sexual overtures on some occasions and on others had submitted “with a sense of powerlessness” but in neither situation had she consented.

It was only later when she was abroad and saw a TV programme about sexual abuse that she grasped the magnitude of what had happened to her, he said. When she returned home, in 2006, she told her parents and later spoke to rabbis in her community.

Two years ago, she sent a letter to Mr Levy, detailing the pain his actions had caused her. It said: “You smouldered and suffocated my soul… stole my education… and virginity. You now question what you can do to make it go away… It will never go away. I cannot buy the things you stole from me.”

The letter went on to suggest that he should apologise to her and reimburse her parents for the counselling and therapy she had undergone.

“If an apology had been forthcoming and resolution possible within the community, she would not have gone to the police,” Mr Markham said.

In a video interview with police played to the jury, the woman said she had felt she had been used “like a utensil” by Mr Levy and had hated what went on.

At one stage, she had taken to cutting herself with a razor — “the only way I could get rid of the pain building up inside me”.

Explaining why she taken time to go to police, she said that “in the religious Jewish world, you don’t call the police for anything unless someone is murdering someone or stealing”.

When she had consulted rabbis, “they basically told me there was nothing they could do; they didn’t know what to do. They all started coming up with their bull**** excuses.”

Repeatedly questioned by the defence barrister as to why she had not told someone, the woman described herself as having been “very naive” and said: “In hindsight if I had known how wrong what he was doing really was, I would have said something.”

He was described as “a good man” by a leading Golders Green rabbi, Chaim Halpern, who gave evidence at the trial.

Prosecutor David Markham called Mr Levy a “predatory and controlling individual” who had exploited a “vulnerable” young woman.

Mr Levy, who had admitted to rabbis that he had had an affair, had followed their suggestions on how to make recompense.

He had made a charitable donation to the family of £1,500 through one rabbi, which the father had kept for the woman’s therapy fees

When another rabbi — Rabbi Halpern — had suggested offering a further payment of £4,000, Mr Levy had been reluctant in case it were taken as an admission of the allegations being made by the family.


“The rabbi said ‘pay it’; he paid it,” but the money was rejected by the family.

Levy was arrested at his home in July 2011 and was charged in April the following year.
Det Con Alistair Woods, from the Sexual Offences, Exploitation and Child Abuse Command, said: “The victim has shown a tremendous amount of courage to come forward and give a detailed account of the abuse she suffered by Levy.
“No one should suffer in silence - I would urge anyone who is a victim to come and speak to us and let us help you.
“Specially trained officers will support you, and thoroughly investigate your claims.
“This sentencing demonstrates that the courts will prosecute those who prey on vulnerable people, irrespective of their background or status.
“I hope today’s sentencing can offer some kind of closure to the victim and her family.”

Orthodox Jewish Girl claims father gang-raped her

A 16-year-old Orthodox Jewish girl was drugged, bound and blindfolded and then gang-raped by her father and his friends, a court heard this week.


The alleged victim, who cannot be identified for legal reasons, said that on two occasions her father tied her hands together, covered her eyes with a blindfold and drove her for about 20 minutes to an unknown location, where six or seven men assaulted, raped and tortured her.

She said that large clips were attached to her breasts and electric shocks passed through them. On one occasion she said the men assaulted her with a live snake. In video evidence played in court, she said: “They put a snake on my body, I could feel there was a snake.”

She also claimed that on another occasion, she was ordered to perform sexual acts on a woman, but refused and started “kicking and screaming”.

She told the court that she had suffered abuse at the hands of her father over a period of seven years.

She said she was beaten if she resisted: “After a bit I felt mentally owned by them, they didn’t have to force me, they would just tell me and I would listen.”

The girl, who is now 18, claimed the abuse began with her father forcing her to take showers with him when she was 10. She said it escalated to rape when she was 14. When she was 16, she said her father began to facilitate her abuse by a family friend, the father of a classmate at the Jewish school she attended.

This began with an assault while she was at the man’s family home for Shabbat dinner.
The girl said her father and the family friend were both present at the gang rape, as well as another man who she described as a Chasidic Jew from Stamford Hill who worked with her father.

Prosecution lawyer Richard Merz said the girl did not tell anyone about the abuse because “her father had made threats that she would be abducted and sold into prostitution and that members of the family would be killed”.

She first made allegations of abuse in 2011 at school, but she revealed its full extent to a visiting rabbi in 2012.

Her father, who is from north west London, is charged with various sexual offences, including three counts of rape, and, with the family friend, of two counts of conspiracy to rape. He is also charged with perverting the course of justice for allegedly offering £1,000 to someone who knew the girl to persuade her not to press charges.

Defence lawyer Jonathan Goldberg QC, said the girl invented the allegations. He claimed she watched pornography on her laptop that depicted group sex and used that as inspiration. He added that teachers at her school thought she was an “attention seeker”.


The trial, at Wood Green Crown Court, continues.

A 45-year-old trainer has accused Chief Rabbi Yona Metzger of sexually harassing him some five years ago, Yedioth Ahronoth reported Monday.

The personal fitness trainer, who is a homosexual, said he decided to talk after the rabbi was questioned under caution by the police this week on suspicion of bribery, fraud, embezzlement, breach of trust and money laundering.
  
The trainer, who also worked as a tour guide, said on Sunday that the alleged incident took place as he was accompanying a group of priests who had met with Metzger at the chief rabbi's office in Jerusalem during their visit to Israel.

"During the meeting I sensed that Rabbi Metzger did not stop looking at me," the man recalled. "After the meeting he approached me and said he could help me get work as a tour guide for groups visiting Israel. 

He asked for my phone number, and then asked if I would accompany him to his office. 

When we entered he closed the door, and from here things got really weird. He asked if I worked as a trainer and said he was looking for one. He told me he also wanted to get massages. I was shocked.

"Then he grabbed my hand and stroked it throughout the entire conversation. I froze. I mean, this is the chief rabbi, and we were in his office," the man said. "He said he wanted a trainer who could also give him massages. 

He said he had an apartment in Tel Aviv and that physical fitness was important to him. 

Then he pointed at his stomach and said 'feel it.' I left his office stunned. Since that meeting he would call me from blocked phone numbers and ask 'When are we going to schedule a training session?' Eventually I gave him the phone number of another trainer, and that's how I got rid of him.

"I told my close friends about the incident immediately. It angered me that in the past he had issued a statement condemning the Gay Pride Parade in Jerusalem. I remember thinking to myself: 'How is he not ashamed of himself?'

Rabbi Metzger responded to the accusations through his attorneys David Libai and Elad Rath, who issued a statement saying the rabbi "has no idea who this man is."

בשיחה הביע האב חשש גם מכך שהפרשה שהתפרסמה נגד הרב הלפרין תזיק בעקיפין לבני הקהילה. 

הגר"ח ברך אותו, ואמר: "עד ראש השנה כל הבנות שלך יתארסו בעזרת השם". 

אמש (ד) חגגו בני המשפחה את שמחת הווארט של הבת השלישית והאחרונה, תוך שהם זוקפים את את השמחה לזכותו של הרב הלפרין. הערב מתקיימת בלונדון שמחת האירוסין, בה צפוי הרב הלפרין להשתתף

Talk of London: An orthodox family whose daughters weren't getting engaged, received the blessing of the Rabbi of the neighborhood of Golders Green, Rabbi Chaim Halperin - and the girls were engaged. 

The father came a few months ago to the residence of Rabbi Chaim Halperin, head of Congregation Divrei Chaim, in Golders Green, London. He cried to him that his daughters are getting older - and their salvation is not in sight. 

During the conversation the father also expressed concern that the affair against Rabbi Halperin which was published may cause indirect harm to the community. 

Reb Chaim blessed him, and said: "By Rosh Hashanah all your girls will get engaged with God's help." 

Yesterday (Wednesday) the family celebrated the engagement, of the third and last daughter, while they attribute the joy to Rabbi Halperin's credit. This evening the engagement takes place in London, and Rabbi Halperin is expected to attend.

Monsey - Dovid Kohn, Gets 8 years for Sex Abuse of girl

A 60-year-old Monsey man who sexually abused a Monsey girl for four years has been sentenced to eight years in prison.

Dovid Kohn, 60, an Israeli national with alias who has been living illegally in the United States, abused the girl from ages 12 to 15.

The victim, now 21, was a friend of one of Kohn’s daughters and spoke at Kohn’s sentencing on Tuesday before Rockland County Court Judge William Nelson.

Prosecutor Arthur Ferraro said the woman told Kohn that he ruined her life but she will carry on. Ferraro said Kohn had told her she could never talk about what happened because the community would view her as tainted and she’d never get a husband.

She told the court that she hopes her decision to speak up publicly would encourage others in the ultra-Orthodox Jewish community to follow suit, Ferraro said.

In some cases, sexual abuse in the community is kept quiet and handled privately, if at all, at the encouragement of some rabbinical leaders. Those who report abuse to the police are sometimes ostracized.

Kohn, who lived at 65 Saddle River Road, asked for less time in prison, as did his lawyer Kenneth Gribetz, who represented him with Deborah Wolikow Loewenberg.

Kohn pleaded guilty in January to one count of first-degree course of sexual conduct. Kohn admitted to having oral sex with the girl between 2004 and 2006 in a plea that covered 35 counts of sexual abuse.

He faced up to 25 years, but the prosecutors offered 10 years in prison. Nelson settled on eight years, 10 years probation, and classification as a sexual offender on the state registry.

The victim reported the acts to Ramapo police and authorities last year. At that time she also spoke with Kohn about the sexual acts while wearing a body wire and through telephone calls recorded by Ramapo police.

According to one transcript of their recorded conversation, the woman told Kohn “you ruined my life,” saying she cut herself and tried to commit suicide.

Kohn told her he wanted to apologize and didn’t want to hurt her. He accused her of trying to blackmail him when she said she would go to the police if he didn’t admit what he had done to her. He said he would “fight like hell.”

Authorities are not sure of Kohn’s identity, though he said in court that he’s lived in Monsey for the past 25 to 28 years. He also has documentation under the name of Avraham Perl, police said, adding they asked federal and international police agencies for a background check.

Kohn told the judge in January that he was born in Israel and overstayed his visa in the United States.


Missing the boat: The Consequences of Rabbinic Leadership failing to deal properly with Abuse

The issue of child abuse and reporting abusers has seen welcome dramatic changes in the last few years. 2006 was the watershed with the publication of New York Magazine's "Does the Orthodox Community have a Catholic Church Problem." A few years later the Novominsker Rebbe got up at an Aguda convention  and publicly acknowledged that child abuse is a problem also in  our community. Aguda leader Rabbi Zweibel advanced this momentum forward a few baby steps. He announced that it was permissible to go to the police - as long as there was "raglayim l'davar" as determined by a rabbi. Despite this progress there still lingered over our community the shame of public discussion, the fear of being labeled a moser, and the difficulty of finding a posek who would not only say to go to the police would acknowledge that he gave the psak. 

The dam of filth and nonsense finally broke this year with a series of cases. The Weberman case in Williamsburg. A young lady had the incredible courage to stand up to the entire Satmar community including the rebbe and testify despite strong cross examination - that she had been abused by one of the communities most respected activists. The abuser was convicted and sent to jail. The as yet undetermined guilt or innocence in the Chaim Halpern case in England and the  Nachum Rabinowitz case in Brooklyn have many shaking their heads in disbelief. There is the ongoing persecution of Manny Waks and his family for reporting abuse. The Baruch Leibowitz case in which he was convicted and then released for retrial on a technicality connected to the apparently false charges against Samuel Kellner for extortion. Finally the straw that broke the camel's back was the case of Yosef Kolko in which not only was a child molested but a distinguished rav and talmid chachom and his family was driven out of Lakewood - for going to the police despite being told by poskim that he was obligated to do so by halacha. Distressingly despite Kolko's confession and clear evidence of guilt and his conviction - the rabbis who participated in the lynch mob have not acknowledged their error and apologized.

It is clear that child abuse has reached a critical mass in our awareness. The Kellner case involves a very distinguished talmid chachom - Rav Chaim Flohr. He is a man of great principle and very careful with every chumra - and he supported Kellner's reporting abuse.  It is no longer the Modern Orthodox versus Chareidim. There are Charedi poskim such as Rav Moshe Sternbuch and Rav Dovid Cohen who tell people to go to the police. Even Rav Yisroel Belsky has publicly announced he agrees. That which we didn't dare whisper five years ago, is the subject of public discussion at the Shabbos table, is the basis of articles in frum media and programs in yeshivas and camps and even the subject of an Artscroll book.

So what is missing? What remains to be done?

Unfortunately what we are missing are the rabbis, the community leaders dealing with the issue properly - both according to the halacha and the psychological reality. The rabbis by and large are being dragged along as we see in Lakewood, Boro Park, Williamsburg, England and Australia. The consequence of this foot dragging and fear of taking leadership roles - is that they are  being left behind. They are increasing being viewed as irrelevant for the big issues our lives. The tide has come and yet they insist on staying behind. In the Kolko case there were gedolei Torah who told the father to go to the police - and now they publicly deny it. They are afraid! How can a gadol be afraid to acknowledge what he has poskened? 

As a consequence of their lack of constructive participation in this horrible issue, emunas chachom is being conflicted and diminished - chas v'shalom. You can't cause or even allow a father with a molested child being run out of Lakewood - and retain the respect of the parents who have watched this debacle. You can't have kids molested in the mikve and schools, who know that rabbis are the last ones to confide in about their pain. Rabbis who say not to report abusers to the police can not retain the respect of parents and children who know that many more kids will be molested. Everyone except the rabbis know that they have no power to stop a pedophile.

The following is the letter that Rabbi Dovid Epstein wrote to apologize for publicly humiliating Kolko's victim's family. It is an incredible act of courage and hopefully it will motivate others who committed the same aveira - to do teshuva. Rabbi Epstein gave explicit permission for this letter to be publicized. Hopefully this will help in the healing process - and aid in Rabbi Epstein's atonement.

CPS publishes guidelines on prosecutors' approach to Child Sexual Abuse cases

Ground breaking new guidelines for prosecutors on how to tackle cases involving child sexual abuse have today been issued by the Director of Public Prosecutions and will take immediate effect. At the same time, the College of Policing has issued guidance for investigators and both documents are now open to a three month public consultation.
Director of Public Prosecutions, Keir Starmer, QC, said: "These guidelines are intended to spell out a different approach to prosecuting these very difficult cases. In particular, the guidelines make clear that the focus for prosecutors must be on the credibility of the allegation being made; and underline that the task is to build strong cases by linking evidence rather than failing to bring cases because of perceived weaknesses in the victim."
The guidance has been informed by a series of roundtables hosted by the CPS and ACPO and attended by front line investigators, lawyers, victims' representatives, academics, social services, the judiciary and others with an interest or expertise in Criminal Justice.
Mr Starmer said: "These guidelines are informed by those involved in protecting children, and it is the valuable contribution of all those who attended the roundtable discussions that has helped to ensure that they are comprehensive and demonstrate the radically new approach we will now be taking.
"Now it is for the public to let us know if they believe we are in the right place and, I hope, to take assurance from the fact that police and prosecutors have worked together to produce this document. We are, without doubt, at a moment of fundamental change in the way we view these offences within the criminal justice system, and in our society as a whole."
National policing lead on violence and public protection, Chief Constable Dave Whatton, said: "This consultation is a moment to reflect on how we can deliver the best for victims of child sexual abuse and ensure the right approach through the entire criminal justice process."
The interim guidelines launched today will be applied to all cases where a sexual offence has been committed against a child or young person. A helpful summary of the guidance can be found here.
On the detail of the guidelines, Mr Starmer said: "A key shift in our approach has to be the way that prosecutors assess the credibility of the allegation being made, rather than making assumptions about the person making them. We do not instinctively question someone who reports a burglary and nor should we a complainant of sexual abuse."
The interim guidelines set out clearly what is to be expected of police and prosecutors with responsibility for these cases from the start and include:
  • The requirement that child sexual abuse cases are only dealt with in specialist teams of prosecutrors, i.e. the Rape and Serious Sexual Offences Units we are establishing in each CPS Area.
  • Arrangements for early consultation and joint work between police and prosecutors to agree a case strategy and address evidential issues head on.
  • A rule that every case must be considered on its facts and merits. Myths, stereotypes and prejudices must be ignored for the purpose of deciding whether there is a realistic prospect of conviction.
  • A requirement that police and prosecutors ensure that appropriate support is available for victims including, where appropriate, counselling.
  • A duty on prosecutors to challenge myths and stereotypes in court and to ensure that cases are progressed as swiftly as possible and trial delay minimised.
Mr Starmer added: "Vulnerability can no longer be a barrier to justice and I want to see prosecutors actively challenging any misconceptions a jury might have. The CPS has talented and experienced professionals who are ready and able to take on these extremely challenging cases."
The roundtable discussions identified a number of other issues relevant to the improvement of the criminal justice response to child sexual abuse cases. These ideas include the introduction of pre-recorded cross examination of victims, a trial for which has today (Tuesday) been announced by the Ministry of Justice. They also include the greater use of intermediaries, the scope for a specialist court, ensuring court cases go ahead on time, and that victims giving evidence in the witness box are not doing so for unnecessarily long periods of time, especially in cases where there are multiple defendants.
We are now working with the Government through the newly formed National Taskforce on Sexual Violence Against Children and the Vulnerable and with the Judiciary to take these issues forward.
Full details for the national scoping panel, which will review complaints made in the past that were not pursued by police and prosecutors, have also been published today.
The consultation can be found on the CPS website.
Alan Wardle, Head of Corporate Affairs at the NSPCC, said: "These are hugely promising developments which we wholeheartedly endorse. Every effort must be made to encourage the victims of child sexual abuse to speak out. And once they have had the courage to do so, the legal system should provide support, not obstacles which often erode their confidence and result in them not able to give their best evidence."
Sue Berelowitz, Deputy Children's Commissioner for England, said: "The Crown Prosecution Service has taken great care to consult organisations working with children when drafting the consultation on a new approach for prosecutors to reviewing cases of child sexual abuse.  The personal commitment of the Director of Public Prosecutions to ensuring child victims are listened to and heard is to be applauded.
"I welcome the creation of a new panel to review historic allegations of child abuse where alleged victims are unhappy with the police or CPS' action.  I'm delighted to have been asked to act as an independent advisor to the panel to help ensure children's voices are properly heard and cases that need to be are reviewed and investigated."
Bernie Ryan, Manager of Manchester's St Mary's Sexual Assault Referral Centre, said: "St Mary's Sexual Assault Referral Centre was pleased to be invited to provide input to the roundtable discussions and to help shape and inform these interim guidelines. There are many  challenges in providing appropriate services and support to people who have experienced child sexual abuse and I hope these draft guidelines will prompt full and frank discussion so that we can all arrive at a national consensus that is both achievable and victim-focussed."

One year in prison for the three sons of the Mishkolitz Rebbe

Yaakov, Yosef and Hertzke Berger, the three sons of the Mishkolitz Rebbe U.S. suffered on Thursday punishment of probation and low financial guarantee in respect of threats, exercising against the husband of the complainant against Nehemiah Weberman of Satmar.

The sentence on Thursday – given by the Supreme Court in Brooklyn, Danny Chun, is one of the residual effects of the Weberman Affair, which ended a few months ago, in which Nehemiah Weberman, a Satmar Hasid, 54, a resident of Brooklyn, who handled the youth close to 30 years was convicted of embarrassing offenses for which he was sent to prison for 50 years.

Berger brothers were arrested, charged and convicted, that in an attempt to intimidate the complainant, they tore the kashrus certificate in the restaurant which was owned by Hershey Deutsch, her husband. Following the incident Deutsch closed the restaurant.

The claim required charging the three with at least 30 days in jail, but the judge released them with the punishment of probation. One of the brothers, Yaakov, was also fined $ 500 for the additional clause he was convicted of.

"It's over," said Attorney Michael Sibla who represented the three. "The prosecution demanded prison sentence just because the case was covered by the media, and became the high-profile case in the U.S."

Immediately after the arrest of the Berger brothers last June, the District Attorney in Brooklyn, Charles Hynes, condemned the orthodox methods of intimidation on the streets in New York against complainants in such affairs.

Hershey Deutsch responded: "I'm glad it's over though they deserve greater punishment. There is a judge, he has rules, and he sentenced them what he thinks they should pay for what they did to me. I think it should be a lesson for the whole community, not to stay quietly anymore, and everyone involved gets the punishment he deserves."

A judgment has not yet been made against a Satmar Hasid who allegedly offered half a million dollars to the complainant for withdrawal of the complaint.

במכתב שכתב הרב הוא קובע כי פטירתו של האברך שהותיר אחריו רעייה ושני ילדים, דורשת מכל אחד ואחד, "התבוננות". במיוחד מאנשים המגדירים עצמם כ"בני תורה".

אז מה עושים כדי למנוע מצבים כאלו בעתיד? "להתחזק בענין שדברנו כבר על החיוב להתפלל על שלומם של התלמידי חכמים שבעיר, ובכל אתר ואתר, כמו שתקנו הקדמונים להתפלל בשבת קודש אחר קריאת התורה 'תפילת יקום פורקן', ולאומרו בכוונה כי אינו דומה תפילה בכוונה מעומק הלב, לתפילה באמירה בעלמא".

עד כאן הדברים מבוססים על דברי חז"ל אך שימו לב לקטע הבא: הסיבה השנייה שלכאורה גרמה לפטירה, היא ביזיונו של הרב חיים הלפרין, ראש קהילת 'דברי חיים', זה אשר נהג לכאורה בצורה בזוייה ופלילית נגד נשים שטופלו אצלו.

"הרי כולנו יודעים מה שקרה בעירנו בשנה האחרונה", כותב הרב שלזינגר, "בזיון תלמיד חכם באופן מבהיל ונורא ולא מחינו על זה כדבעי. ואנו צריכים להתחזק בכבוד תלמידי חכמים ולמחות על בזיונם


Rabbi Elyakim Schlesenger, a  Rosh Yeshiva in London, has blamed the sudden death of a 27-year-old married yeshiva student from pneumonia on those in the Haredi community who have denigrated or embarrassed  Chaim Halpern, who is currently under police questioning for allegedly sexually abusing several women he was counseling.
Rabbi Elyakim Schlesenger's statement, reported by Behadrei Haredi, is meant to attack those Haredim who are cooperating with the police investigation against Halpern.
Halpern, who heads his own London synagogue, was an unlicensed marriage counselor.
